Terms of Service

These terms are the agreement between you and Africafe (Africafe.us) when you use africafe.us or buy from us. Please read them. By using the site or placing an order you agree to them.

Who may use the site

You must be at least 18 years old, or the age of majority where you live, and able to enter a binding contract. By using the site you confirm that you are.

Your account

You can check out as a guest or use a passwordless account, where we email you a one-time code to sign in — we do not store a password. Keep access to your email secure, since anyone with your code can sign in. Tell us promptly if you think your account has been used without your permission.

Products, pricing, and availability

We try to describe our products, prices, and stock accurately, but errors happen. Prices are in U.S. dollars and can change at any time before you order. If a product is listed at an obviously wrong price or is out of stock, we may cancel the order and refund you in full — we will contact you if we do. Any strike-through or “compare-at” price reflects a genuine former price.

Orders and acceptance

Your order is an offer to buy. We accept it when we send your order confirmation; until then we may decline or limit any order — for example, to correct an error or prevent suspected fraud. A confirmation email does not guarantee acceptance if a pricing or stock error is later found.

Payment

Payments are handled by Stripe on a secure hosted checkout. You authorize us, through Stripe, to charge your chosen payment method for the total shown, including tax and shipping. We do not receive or store your full card number. Sales tax is calculated and applied at checkout where required.

Shipping, returns, and refunds

Shipping rates and timelines are set out in our Shipping Policy, and returns and refunds in our Refund Policy. Those policies are part of these terms.

Food products and labels

We sell coffee and coffee-based food products. Product pages describe the item, its ingredients and allergens, net weight, and country of origin. Please read the label and ingredient information before consuming, especially if you have allergies. Descriptive taste notes are our opinion, not health claims.

Loyalty, referrals, and wholesale

Where we offer a loyalty program, referral credit, or wholesale account, additional terms apply and will be shown when you enroll. Loyalty points have no cash value, cannot be exchanged for money, may expire, and we may change or end a program with reasonable notice. These programs are not all available yet; this section governs them when they are.

Intellectual property

The Africafe name, logo, site design, text, and images are owned by us or our licensors and are protected by law. You may use the site to shop and to view content for your own use. You may not copy, resell, or use our content or branding without our written permission.

Acceptable use

Do not use the site to break the law, infringe others’ rights, interfere with its operation or security, scrape it at scale, or attempt to access accounts or data that are not yours.

Reviews and submissions

Where we let you post reviews or other content, you are responsible for what you submit, you confirm it is truthful and your own, and you give us permission to display it. We may remove content that is unlawful, misleading, or off-topic, and we do not selectively suppress honest negative reviews.

Disclaimers

The site and products are provided “as is” to the fullest extent the law allows. We do not promise the site will always be available or error-free. This does not exclude any warranty that cannot be excluded under applicable law, including your rights as a consumer.

Limitation of liability

To the fullest extent the law allows, Africafe is not liable for indirect, incidental, or consequential damages arising from your use of the site or products, and our total liability for any claim will not exceed the amount you paid for the order the claim relates to. Some jurisdictions do not allow these limits, so they may not fully apply to you.

Indemnification

You agree to cover our reasonable losses if they arise from your misuse of the site or your breach of these terms.

Governing law and disputes

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in Harris County, Texas, and you and we agree to that jurisdiction. Nothing here removes a right you have to bring a claim where the law guarantees it.

Changes to these terms

We may update these terms. When we do, we will update the date at the top of this page, and material changes take effect when posted. Continuing to use the site means you accept the updated terms.
